In these Terms of Service, the terms “we”, “us” and “our” refer to Arkitaip Limited.
We operate this website and online store, including all related information, content, features, tools, products and services made available through it (the “Services”).
Our store is hosted on Shopify, which enables us to provide the Services to you.
These Terms of Service, together with any policies referred to in them, including our Privacy Policy and Refund Policy, set out the terms on which you may access and use our Services and purchase products from us.
Please read these Terms carefully before using our Services. By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy.
If you do not agree to these Terms, you must not use our Services. Nothing in these Terms affects your statutory rights as a consumer.

SECTION 1 - ACCESS AND ACCOUNT
To use our Services, including browsing our website or placing an order, you may be asked to provide certain information, such as your name, email address, billing address, shipping address and payment details.
You agree that all information you provide to us is accurate, current and complete, and that you have the right to provide it.
You are responsible for maintaining the confidentiality of your account details and for all activity carried out under your account. You must notify us promptly if you believe your account has been accessed without authorisation.
You must be at least 18 years old, or have the permission of a parent or legal guardian, to use our Services.
We reserve the right to suspend or terminate your account, or restrict access to the Services, where we reasonably believe you have breached these Terms or used the Services unlawfully.
SECTION 2 - OUR PRODUCTS
We make every reasonable effort to ensure that product descriptions, images and other content on our website are accurate.

All product descriptions, availability and pricing are subject to change at any time without notice.
We reserve the right to withdraw any product from sale and to limit quantities purchased per order, customer, household or address where reasonably necessary.
Nothing in this section limits your legal rights in relation to goods that are faulty, not as described, or otherwise do not conform with the contract.
SECTION 3 - ORDERS
When you place an order through our website, you are making an offer to purchase the products selected.
After you place an order, you will receive an acknowledgement email confirming receipt. This does not mean that your order has been accepted.
A contract between you and us is formed only when we accept your order. Acceptance takes place when we send you an email confirming that your order has been accepted and/or dispatched.
We reserve the right to refuse or cancel any order before acceptance, including where:
A product is unavailable;
There has been an error in the price or description of the product;
We are unable to obtain payment authorisation; or`
We reasonably suspect fraud or other unlawful activity.
If we cancel your order after payment has been taken, we will refund you in full using the original payment method.
Please check your order carefully before submitting it. Once an order has been accepted, we may not be able to amend or cancel it. However, your statutory cancellation rights and any rights under our Shipping & Refund Policy will still apply.
You confirm that products purchased from us are for personal use and not for resale unless we have agreed otherwise in writing.
SECTION 4 - PRICES, PAYMENT AND TAXES
The price payable for goods will be the price shown on our website at the time you place your order, except in the case of obvious error.
Prices shown to customers in the United Kingdom are stated in Pounds Sterling (£) unless otherwise indicated.
Where applicable, prices include VAT. Delivery charges, customs duties and any other applicable charges will be shown at checkout or otherwise before you complete your order.
If you order from outside the United Kingdom, your order may be subject to import duties, taxes and customs charges imposed by the destination country. You are responsible for paying any such charges unless we expressly state otherwise (please refer to our Shipping & Refund Policy for more information).
You agree to provide current, complete and accurate billing, payment and account information for all purchases.
By placing an order, you confirm that:
The payment method used is yours, or you are authorised to use it; and all payment information provided is accurate.
If we are unable to process your payment, we may refuse or cancel your order.
SECTION 5 - SHIPPING AND DELIVERY
We will deliver the goods to the delivery address you provide during checkout.
Delivery times shown on our website are estimates only unless we expressly agree on a specific delivery date with you. We will deliver your order without undue delay and, unless otherwise agreed, within 30 days of the date of order acceptance.
We are not responsible for delays caused by events outside our reasonable control, including courier disruption, customs delays, severe weather, strikes or supply chain issues. If such a delay occurs, we will use reasonable efforts to keep you informed.
For consumer orders, the goods remain at our risk until they come into your physical possession or the possession of a person identified by you to take delivery of them. If you arrange your own independent carrier not offered by us, risk passes to you when the goods are delivered to that carrier.
Ownership of the goods passes to you upon receipt of payment in full for the goods and any applicable delivery charges.
YOUR RIGHT TO CANCEL AND RETURNS
If you are a consumer in the UK, EEA or another jurisdiction where mandatory cancellation rights apply, you may have a legal right to cancel your order within a specified cooling-off period.
For most online consumer sales, you have the right to cancel your order within 14 days after the day on which you, or a person nominated by you, receive the goods, subject to any exceptions required or permitted by law.
To exercise your right to cancel, you must inform us of your decision to cancel by a clear statement, for example, by email to hola@arkitaip.com.
If you cancel within the applicable cancellation period, you must return the goods to us in accordance with our Refund Policy.
We will process any refund due in accordance with applicable law and our Refund Policy. Your statutory rights and any rights under our Refund Policy are not affected. Please see our Refund Policy for full details of cancellations, returns, exchanges and refunds.
Nothing in these Terms affects your legal rights under the Consumer Rights Act 2015 or any other applicable consumer protection law.
If goods you receive are faulty, damaged, not as described, or otherwise not in conformity with the contract, you may be entitled to a repair, replacement, price reduction or refund in accordance with your legal rights.

Shopify’s name and logo are trade marks of Shopify and belong to their respective owner.

Such tools and services are provided for convenience only. We do not control and are not responsible for the content, functionality, availability or terms of any third-party services.
Your use of any third-party tools or services is entirely at your own risk and may be subject to separate terms and privacy policies imposed by the third-party provider.
We may add, remove or change features, tools or functionality at any time.

SECTION 9 - RELATIONSHIP WITH SHOPIFY
Our online store is hosted by Shopify. Shopify enables us to provide the e-commerce platform through which we sell our products to you.
However, any contract for the purchase of goods made through our store is between you and Arkitaip Limited only, and not with Shopify.
To the fullest extent permitted by law, Shopify shall have no liability to you in relation to any purchase made from our store.
SECTION 10 - PRIVACY POLICY
We collect and process personal data in accordance with our Privacy Policy, which explains how we use your information.

If we cancel an order after payment has been taken, we will refund you in full.

If you are a consumer, we are responsible for losses you suffer that are a foreseeable result of our breach of these Terms or our negligence. We are not responsible for any loss or damage that is not foreseeable.
We supply the products and Services for domestic and private use only. We are not liable for business losses, including loss of profit, loss of business, business interruption or loss of business opportunity.
If you are not a consumer, our total liability to you arising out of or in connection with these Terms, whether in contract, tort (including negligence), breach of statutory duty or otherwise, shall be limited to the total amount paid by you for the relevant products giving rise to the claim.

If you are a consumer, this section does not apply to you except to the extent permitted by law.
If you use the Services in a business capacity, you agree to indemnify and keep indemnified Arkitaip Limited, its affiliates, officers, directors, employees, agents and service providers against all losses, liabilities, costs and expenses arising out of or in connection with your breach of these Terms, misuse of the Services, or infringement of any third-party rights.

If you live outside the United Kingdom, you may also have mandatory rights under the laws of your country of residence.
We may update these Terms from time to time to reflect changes in our business, legal or regulatory requirements, or the Services we provide.
The latest version of the Terms will always be posted on this page. Where required by law, we will notify you of material changes.
Your continued use of the Services after any changes take effect constitutes your acceptance of the revised Terms.
